**In short:** carrier liability insurance protects the transporter if a customer claims for lost or damaged cargo. Goods in transit insurance protects the owner of the goods. They cover different people, and a damaged shipment can involve both.

## Carrier liability vs goods in transit: at a glance

| | Carrier liability insurance | Goods in transit insurance |
| --- | --- | --- |
| **Who buys it** | Lorry, haulage and logistics companies | The owner of the goods (manufacturer, trader, retailer) |
| **Who it protects** | The carrier, against claims from customers | The goods owner, against loss of or damage to the goods |
| **What it pays** | The carrier's legal liability, usually up to the limit in the contract or policy | The value of the goods, up to the sum insured |
| **Typical triggers** | Accident, theft or damage while the carrier has the goods | Theft, accident, fire, or damage in transit, depending on the policy |
| **Main limit** | Liability caps and exclusions in the transport contract | The sum insured, exclusions and conditions on packing and vehicles |

## Understanding carrier liability insurance

Carrier liability insurance covers the legal liability of the carrier transporting goods. If cargo is lost, damaged or delayed while in the carrier's care, the owner may claim against the carrier, and this insurance helps the carrier respond to that claim.

It usually does not cover the full value of the goods. The amount payable is normally limited by the transport contract, the policy limit and the law that applies, and some causes of loss are excluded.

![Goods in transit insurance protecting the goods owner](https://www.coverbuddies.com/hs-fs/hubfs/Carrier%20Liability%20vs%20Goods%20in%20Transit%206.png?width=1200&height=600&name=Carrier%20Liability%20vs%20Goods%20in%20Transit%206.png)

### Exploring goods in transit insurance

[Goods in transit insurance](https://www.coverbuddies.com/marine-insurance-malaysia) protects the owner of the goods. It is arranged around the goods themselves, so it can cover their value against risks such as theft, accident and damage during the journey, and it can be tailored to the type of goods and the routes used.

Because it does not depend on the carrier being at fault, the owner can claim even when the carrier's liability is capped or the carrier is not responsible at all.

## A simple example

A distributor sends RM100,000 of stock by lorry. The transport contract limits the carrier's liability to a small amount per package or by weight. The lorry is involved in an accident and most of the stock is damaged.

- With **carrier liability insurance only**, the carrier's insurer may pay the capped amount on the carrier's behalf. The distributor bears the shortfall.
- With **goods in transit insurance**, the distributor claims the loss from its own insurer up to the sum insured, without waiting to prove the carrier was at fault.

The exact outcome depends on the contract and the policy wording, so check both before the goods move.

## Key differences

The main difference is who is protected. Carrier liability insurance protects the transporter from customer claims, and the payout is shaped by the contract and the law. Goods in transit insurance protects the owner, and the payout is shaped by the sum insured and the policy terms.

![Key differences between carrier liability and goods in transit insurance](https://www.coverbuddies.com/hs-fs/hubfs/Carrier%20Liability%20vs%20Goods%20in%20Transit%204.png?width=1200&height=600&name=Carrier%20Liability%20vs%20Goods%20in%20Transit%204.png)

## What carrier liability insurance usually covers

Policy wording differs between insurers, so always check the exact terms. In general, carrier liability insurance responds to:

- **Accident:** cargo damaged or lost when the vehicle overturns, collides or catches fire
- **Theft:** goods stolen from the vehicle while they are in the carrier's care
- **Mishandling:** damage during loading, unloading or transfer
- **Legal costs:** the cost of defending a customer's claim, usually in addition to any settlement

Some policies also respond to a customer's financial loss caused by delay, and others limit or exclude it, so ask your insurance broker or agency.

## What it usually does not cover

- Damage caused by poor packing or labelling by the shipper
- Inherent vice, meaning damage from the natural nature of the goods, such as produce that spoils on its own
- High-value items such as jewellery, art or electronics, unless they are declared and agreed with the insurer
- Deliberate or dishonest acts
- Goods the carrier owns itself

## When to choose carrier liability insurance

Carrier liability insurance is for lorry operators, haulage firms and logistics companies that carry other people's goods and could be sued if something goes wrong. It helps the business meet customer claims and, in many cases, customers or contracts ask to see it. It also builds trust: customers are more likely to give work to a carrier that can show financial protection for their goods.

![When to choose carrier liability insurance](https://www.coverbuddies.com/hs-fs/hubfs/Carrier%20Liability%20vs%20Goods%20in%20Transit%203.png?width=1200&height=600&name=Carrier%20Liability%20vs%20Goods%20in%20Transit%203.png)

## When to choose goods in transit insurance

Choose goods in transit insurance if you own the goods being moved, whether you send them with your own vehicle, a courier or a third-party haulier. It matters most for high-value stock, fragile items, or routes with a higher risk of theft or accidents.

## Do I need both?

Many businesses do. A logistics company that also moves its own stock may carry both types, and a business that ships through third parties often uses goods in transit insurance to cover the gap left by the carrier's liability limit.

## How to choose a policy

- **Know your goods:** the type and value of what you carry decides the limit you need and what must be declared.
- **Know your routes:** local road runs, cross-border trips and sea or air legs carry different risks and may need different cover.
- **Match your contracts:** check what limit your customers' contracts or conditions of carriage expect, and make sure the policy supports it.
- **Declare high-value cargo:** items that are excluded by default can often be added if you tell the insurer first.

## Common questions

### If the carrier is at fault, do I still need goods in transit insurance?

Often yes. The carrier's liability is usually capped, so the cap may be well below the value of your goods. Goods in transit insurance covers the difference up to your sum insured.

### Does carrier liability insurance cover my own goods?

No. It covers the carrier's legal liability for other people's goods, not goods the carrier owns.

### Does my motor fleet policy cover the goods on the truck?

Usually not. Motor insurance deals with the vehicle and third-party injury or property damage. It generally does not cover the cargo being carried, so check your policy wording.

### Is carrier liability insurance a legal requirement in Malaysia?

It is usually a contractual requirement rather than a blanket legal one. Customers and principals often ask carriers for proof of cover before awarding work, and some licence or contract conditions may also call for it, so check what applies to you.

### Is it the same as freight forwarder liability insurance?

No. Forwarders arrange the movement and are responsible for their own errors and for the supply chain they manage. Carriers physically move the goods. See our [guide to freight forwarders liability insurance](https://www.coverbuddies.com/en/knowledge-hub/detailed-guide-to-freight-forwarders-liability-insurance-policies).

### Is goods in transit the same as marine cargo insurance?

They are related but not identical. Goods in transit usually covers road journeys within a country, while marine cargo covers shipments by sea or air. See our [marine insurance guide](https://www.coverbuddies.com/marine-insurance-malaysia) for the difference, and read [marine cargo insurance and Incoterms](https://www.coverbuddies.com/en/knowledge-hub/marine-cargo-insurance-and-incoterms-who-insures-the-goods) to see how sale terms decide who insures the goods.
