Professional Indemnity Insurance for IT and Tech Companies in Malaysia
What professional indemnity covers for IT consultants, software houses and digital agencies in Malaysia, and what client contracts often ask for.
If your business builds software, runs systems or advises clients on technology, a mistake can cost your client far more than your fee. A bug at launch, a failed migration or a wrong recommendation can stop their operations. Professional indemnity (PI) insurance is the cover that responds when a client says your work caused them a financial loss. This guide explains how it applies to IT consultants, software houses and digital agencies in Malaysia.
The short answer
If you are paid for technology advice, development, implementation or support, you are a likely candidate for PI. It typically pays your legal defence costs and any compensation or settlement you are found to owe, up to the limit on your policy. Defending a claim can be expensive even when you did nothing wrong, which is a large part of why the cover matters.
Our professional indemnity insurance in Malaysia page explains how we arrange it.
Who counts as an IT or tech business
- Software developers and software houses, including custom development and app builds.
- IT consultants and system integrators, including cloud, ERP and infrastructure projects.
- Managed service and support providers, who run or maintain systems for clients.
- Digital and web agencies, including website builds, e-commerce and digital marketing technology.
- Freelance and contract IT professionals working directly for corporate clients.
Claims PI is designed to respond to
These are illustrations, not claims we have handled.
- A system you delivered fails shortly after go-live, and the client claims for the revenue lost while it was down.
- A data migration you handled corrupts or loses client records.
- Your recommendation of a platform turns out to be unsuitable for the client's needs, and they pay to replace it.
- A project overruns because of an error in your scoping or estimates, and the client claims for the extra cost.
- Code or content you delivered infringes someone else's intellectual property, and the client is sued.
Why clients ask for it
Larger and regional clients often write PI requirements into their contracts or vendor onboarding. A common pattern is a minimum limit of indemnity, a certificate of insurance before work starts, and a requirement to keep the cover in force for a period after the project ends. Read the insurance clause before you sign, because it can decide the limit you need to buy.
What to check in a policy
- Limit of indemnity: the most the insurer will pay. Match it to your largest contracts and any minimum your clients require.
- Claims-made basis: most PI policies cover claims made and reported while the policy is in force, so keep it in place and renew it. See does professional indemnity cover advice I gave before I had the policy?
- Retroactive date: decides how far back your past work is covered.
- Contractual liability: PI is built around your duty of care. Promises and guarantees you give in a contract may not be covered, so check how the wording treats them.
- Intellectual property and data: wordings differ on how far they respond to IP claims, and PI is not a substitute for cover against a data breach or cyber attack. See cyber insurance in Malaysia.
- Exclusions: PI does not cover deliberate wrongdoing or fraud, and does not usually cover bodily injury or property damage.
PI, cyber and public liability: how they fit together
- Professional indemnity covers financial loss from your advice, code or service.
- Cyber insurance covers a data breach or attack on your own systems and the response costs. If you hold client data, consider it alongside PI.
- Public liability covers physical injury or property damage to other people. See professional indemnity vs public liability: which do you need?
What affects the cost
PI is a non-standard product, so insurers assess each business individually. The main factors are your type of work, your annual revenue or fees, the limit you choose, the excess, your claims history and how you manage projects, for example written scopes, contracts and testing. To quote, we usually ask for your company and director details, annual turnover, the services you provide, your main clients and the size of your largest contracts, any past claims, and the limit you are considering or your clients require. We compare options across insurers and explain the trade-offs, and an insurer may decline a risk that another accepts.
