Who Needs Professional Indemnity Insurance in Malaysia, and What Does It Cost?

Who needs professional indemnity insurance in Malaysia? See which professions should have it, what affects the cost, and how it differs from public liability.

If you are paid for your advice, designs or services, you can be blamed when something goes wrong, even if you did your best. Professional indemnity (PI) insurance is the cover that pays for that kind of claim. This guide explains who needs it in Malaysia and what decides the price.

The short answer

Any business or professional whose work is advice, design, analysis or a service that a client relies on should look at PI. If a mistake, a missed deadline or a wrong recommendation could cost your client money, a claim can land on you. Defending that claim can be expensive even when you did nothing wrong, and PI is built to cover both the legal costs and any compensation you are found to owe.

Our professional indemnity insurance page explains what the cover includes and how we arrange it.

Who usually needs it

  • Consultants and advisers: management, business, HR, marketing, IT and engineering consultants.
  • Accountants, bookkeepers and tax agents: an error in a filing or a set of accounts can cost a client money.
  • Architects, engineers and surveyors: design or specification errors can be very costly to put right.
  • IT, software and digital agencies: a system failure or bug can cause a client's business to lose revenue.
  • Medical and other licensed professionals: see what insurance doctors in Malaysia need for an example.

If you are not sure whether your work counts, ask yourself one question: could a client lose money because of my advice or my work? If yes, PI is worth a conversation.

When a client or professional body asks for it

Some professional bodies set their own insurance requirements for members, and many clients, landlords and tender documents ask for proof of PI before they will sign. Check your regulator's rules and your contracts. A contract that asks for a minimum limit of cover or a certificate of insurance is a good sign that PI is expected in your industry.

What decides the cost

There is no single price, because premiums depend on how risky your work is for an insurer. The main factors are:

  • Your profession and the kind of work you do. Advice that can lead to a large financial loss is rated higher than low-risk services.
  • Your annual revenue or fees. More income usually means more exposure.
  • The limit of indemnity. A higher limit gives you more protection and costs more.
  • The excess. A higher excess usually lowers the premium.
  • Your claims history and how you work. Written contracts, quality checks and clear scopes of work all help.
  • The retroactive date. This decides how far back the policy covers. Read does professional indemnity cover advice I gave before I had the policy? before you assume past work is covered.

How much cover should you buy?

Start with the biggest loss one client could reasonably claim from you, then check what your contracts require. Cover that matches the size of your largest projects is better than a cheap policy with a limit too low to matter. We can compare options across insurers and explain the trade-offs.

PI is not the same as public liability

PI covers claims about your advice and professional mistakes. Public liability covers injury or property damage to other people. Many businesses need both. See our guide to professional indemnity vs public liability for how to decide.
